This Acceptable Use Policy (“AUP”) sets out the rules and standards that apply to all customers of UK Dedicated Servers Limited in connection with their use of any service we provide, including dedicated server hosting, colocation services, connectivity, cloud hosting, and any ancillary or managed services.
By entering into a service agreement with UK Dedicated Servers Limited, or by using any of our services, you agree to be bound by this AUP. We reserve the right to update this AUP from time to time. Continued use of our services following notification of any changes constitutes acceptance of the revised AUP. Any activity not expressly listed here may still constitute a violation if it is illegal, irresponsible, or disruptive in nature. No service credits will be issued for any interruption in service arising from enforcement of this AUP.
1. Scope
This AUP applies to:
- All customers of UK Dedicated Servers Limited, whether on a managed or unmanaged basis.
- All users, employees, contractors, sub-customers and agents of the customer who access or use our services.
- All equipment hosted, colocated or connected at our facilities or on our network.
- All data, content and communications transmitted over or stored on our infrastructure.
Customers are responsible for ensuring that all persons who access or use services under their account comply with this AUP. We may hold customers directly liable for violations committed by their sub-customers, users or agents.
2. Lawful Use
All services must be used for lawful purposes only. The following are strictly prohibited:
- Transmission, storage, distribution, or presentation of any content that is unlawful under the laws of England and Wales or any other applicable jurisdiction.
- Use of services to facilitate, participate in, or support any criminal activity including fraud, money laundering, identity theft, or any activity prohibited under the Computer Misuse Act 1990, the Fraud Act 2006, or any other applicable legislation.
- Storage or transmission of material that is defamatory, grossly offensive, harassing, threatening, or which incites violence or hatred against any person or group.
- Distribution of content that infringes copyright, trade marks, patents, or other intellectual property rights.
- Any activity that constitutes harassment, stalking, fraud, or abuse.
- Solicitation of any illegal activity, even if the activity itself is not performed.
- Knowingly receiving, downloading, storing or distributing a file that cannot be lawfully possessed, distributed or downloaded.
Legal adult content is permitted on the UK Dedicated Servers Limited network, subject to all applicable laws and regulations including the Online Safety Act 2023.
3. Network and System Security
Customers are solely responsible for the security of systems and equipment under their control. Violations of system or network security are prohibited and may result in criminal and civil liability. We may investigate incidents involving such violations and will cooperate fully with law enforcement where a criminal violation is suspected or confirmed.
Prohibited Activities
- Unauthorised access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without the express authorisation of the owner.
- Unauthorised monitoring of data or traffic on any network or system without the express authorisation of the owner.
- Interference with service to any user, host or network including mail bombing, network flooding, deliberate attempts to overload a system, and broadcast attacks.
- Forging of any TCP/IP packet header, email header, or any other protocol header information.
- Port scanning, vulnerability scanning, or network probing of any system on our network or any third-party network without the prior explicit written permission of UK Dedicated Servers Limited and the system owner.
- Penetration testing or stress testing of any device on our network without prior explicit written permission.
- Participating in or facilitating any distributed denial of service (DDoS) attack against any system, network, or service.
- Deploying malware, viruses, worms, trojans, ransomware, spyware, or any other malicious software.
- Operating open proxies, open mail relays, Tor exit nodes, or similar services that facilitate anonymous abuse without prior written agreement.
In the event that a customer’s server or equipment is found to be the source of or involved in an attack on any other server, system, or network, we reserve the right to immediately suspend or terminate services to that customer without prior notice. 4. Password and Access Security
- Customers must not use or permit anyone else to use our services to attempt to guess, crack, or obtain passwords or access credentials belonging to any other person or system.
- Customers must not share account credentials with unauthorised persons.
- Customers must notify us promptly if they suspect that any access credentials have been compromised.
- Customers are responsible for maintaining their contact information in the customer portal at all times, including a reachable email address even in the event of services being suspended.
5. Email and Spam
UK Dedicated Servers Limited operates a zero tolerance approach to the sending of Unsolicited Commercial Email (UCE), commonly known as spam.
- Customers must not use or permit others to use our services to send unsolicited commercial email to any recipient who has not explicitly opted in to receive it.
- Customers must not host, or permit hosting of, websites or services that are advertised by means of spam email sent from other networks.
- All mailing lists operated from our infrastructure must be true confirmed opt-in lists. Confirmation records must be retained and must be made available to us on request.
- Customers must comply with the Privacy and Electronic Communications Regulations (PECR) 2003 and any subsequent amendments in relation to the sending of electronic marketing communications.
- Resellers are responsible for ensuring that their own customers comply with these requirements and may be held directly liable for spam originating from systems under their account.
Violation of this section may result in immediate suspension or termination of service. We reserve the right to pursue civil remedies for any costs incurred as a result of a substantiated violation and will notify law enforcement where the violation is believed to be a criminal offence.
6. Copyright and Intellectual Property
Our network may only be used for lawful purposes. Customers must not use our services to transmit, store, distribute or facilitate access to material that infringes the intellectual property rights of any third party. This includes but is not limited to:
- Copyrighted software, music, films, television programmes, books, or other works where the customer does not hold the appropriate licence or right to distribute.
- Material protected by trade marks, patents, trade secrets, or other proprietary rights.
- Operating or hosting BitTorrent trackers, indexing services, or similar systems primarily used to facilitate copyright infringement.
We will respond to valid notices of copyright infringement in accordance with our obligations under applicable law, including the Digital Economy Act 2017. Repeated infringement may result in termination of service.
7. DDoS Protection – Fair Use Policy
UK Dedicated Servers Limited provides DDoS mitigation services across three tiers: On-Demand Detect & Redirect, Always-On In-Line, and Always-On Pro In-Line & Managed. Where DDoS protection is provided as part of or ancillary to a customer’s service, the following fair use conditions apply. Full details of service plans, capacities, pricing and coverage are set out in the DDoS Mitigation Service Datasheet.
- All DDoS protection services are provided on a best-efforts basis. We do not guarantee complete mitigation of all malicious traffic due to the continually evolving nature of attack vectors.
- Customers on the no-cost On-Demand plan who receive frequent DDoS attacks may be required to adopt a rolling null-route threshold policy or upgrade to a paid plan in order to protect the integrity of the network for other customers.
- On-Demand protection operates with 1:2000 packet sampling and a time-to-mitigate of up to 150 seconds. Where near-instant mitigation is required, customers should subscribe to an Always-On In-Line plan.
- Each service tier carries a defined scrubbing quota and bandwidth limit. Customers who consistently exceed their tier’s capacity may be required to upgrade. Additional charges may apply for customers with more than 4 Gbit/s 95th percentile incoming clean traffic on Always-On tiers.
- We reserve the right to impose further restrictions, apply null-routing, or terminate services in the event of severe network risk caused by DDoS attacks, regardless of the customer’s service tier.
- The use of IP tunnels to other datacentres or networks for the purpose of utilising our DDoS protection infrastructure outside of our own network is not permitted unless explicitly agreed in writing.
8. Network Responsibility
Customers have a responsibility to use our network in a manner that does not adversely affect other customers or the integrity of the network. We reserve the right to suspend or terminate service to any customer whose use of the network negatively impacts other customers or the wider network. The following are prohibited:
- Attacking or attempting to gain unauthorised access to servers, services, or network infrastructure belonging to UK Dedicated Servers Limited or any other customer.
- Participating in any behaviour that results in retaliatory actions against our network, infrastructure, or other customers.
- Consuming excessive network or infrastructure resources in a manner that disrupts or degrades service for other customers.
9. Datacentre Access and Physical Use
The full procedures for physical access to our Coventry datacentre — including site access, identification requirements, photography policy, shipments, rackspace guidelines, airflow and containment, safety and conduct, and fire procedures — are set out in the UK Servers Co-Location Information Handbook.
All customers with colocated or physically hosted equipment are required to read, understand and comply with the Co-Location Handbook. The Handbook forms part of this AUP. The key principles are summarised below.
Site Access
- All visits must be pre-arranged via an access request through the customer portal at control.ukservers.com, with a minimum of 15 minutes’ notice.
- Government-issued photo ID is mandatory for all persons requiring access (valid passport, driving licence, or armed forces photographic ID).
- Any persons not named on the access request, or who cannot present valid identification, will not be permitted access.
- Customers with overdue invoices will not be permitted to access the site or remove equipment until all outstanding amounts have been settled.
Physical Conduct
- No food, drink, or liquids are permitted in the data halls.
- No cardboard, packaging, or flammable materials are permitted in the data halls. All packaging must be removed after installation.
- Customers must wear appropriate closed-toe footwear when accessing the datacentre floor.
- Hot works (soldering, welding, grinding, or similar) are not permitted without prior written approval.
- Smoking, including e-cigarettes and vaping, is not permitted inside the building.
- Customers must not touch, tamper with, or interfere with equipment that does not belong to them.
- Floor tiles must not be lifted without prior permission from UK Dedicated Servers Limited.
- Public walkways must not be obstructed at any time.
- No noxious substances, firearms, ammunition, or offensive weapons may be brought onto the premises.
Photography
Customers may photograph their own dedicated rackspace only. Photography of other customers’ equipment, shared infrastructure, or the wider facility is strictly prohibited. No photography is permitted in shared co-location racks. Visitors found photographing other customers’ equipment or facility infrastructure may be escorted off site without prior warning.
Shipments and Deliveries
All shipments to site must be pre-notified via the customer portal or by email to support@ukservers.com, and must be clearly labelled with your Customer ID or ticket reference. Full details of the shipment procedure, free storage periods, and storage charges are set out in the Co-Location Handbook.
Airflow and Containment
Our data halls operate a hot-aisle / cold-aisle containment system. All equipment must be installed so that cool air is drawn from the front of the rack and hot exhaust is expelled to the rear. We reserve the right to reposition equipment or apply blanking panels to any rack that violates the containment policy.
10. Suspension and Termination
UK Dedicated Servers Limited reserves the right to suspend or terminate network access, power, or any other service to any customer, at any time and without prior notice, if in our reasonable judgement:
- The customer’s equipment or account is the source or target of a violation of this AUP.
- The customer’s use of services is causing harm, disruption, or risk to UK Dedicated Servers Limited, other customers, or third parties.
- We have reasonable grounds to believe that a criminal offence is being or has been committed.
- The customer has failed to make payment by the due date.
Where inappropriate activity is detected, all accounts associated with the customer may be suspended whilst an investigation is carried out. Prior notification is not guaranteed. Where a criminal violation is suspected or confirmed, we will contact the relevant law enforcement authorities. No service credits will be issued in respect of any period of suspension arising from a policy violation. Our decision in all matters pertaining to the interpretation and enforcement of this AUP shall be final.
11. Indemnification
The customer agrees to indemnify and hold harmless UK Dedicated Servers Limited, its directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or in connection with any violation of this AUP by the customer or any person using the customer’s account or services.
12. Disclaimer of Responsibility
UK Dedicated Servers Limited is under no duty to monitor customer or user activity to determine whether a violation of this AUP has occurred, and does not assume any responsibility to actively police internet-related or hosted activities. We disclaim all responsibility for any inappropriate use of our services and any liability to any person for any other person’s violation of this AUP.
We cannot take responsibility for the security of information transmitted over our facilities. Customers are urged to treat all online communications as potentially insecure and to implement appropriate security measures for their own systems and data.
13. Governing Law
This AUP is governed by the law of England and Wales. Any dispute arising in connection with this AUP shall be subject to the exclusive jurisdiction of the courts of England and Wales.
